America Must Reform its Legal System and Its Penal System!



The Economist leads with an article titled "American prisons: The right choices".
No country in the world imprisons as many people as America does, or for so long. Across the array of state and federal prisons, local jails and immigration detention centres, some 2.3m people are locked up at any one time. America, with less than 5% of the world’s population, accounts for around 25% of the world’s prisoners. The system is particularly punishing towards black people and Hispanics, who are imprisoned at six times and twice the rates of whites respectively. A third of young black men can expect to be incarcerated at some point in their lives. The system is riddled with drugs, abuse and violence. Its cost to the American taxpayer is about $34,000 per inmate per year; the total bill is around $80 billion.
That $80 billion is of course only the cost of running the prisons payed by taxes. It does not include the an estimate of the human cost of the pain and suffering of the prisoners in the U.S. who would not be in prison had they lived in another country, nor the cost to the economy of the lost productivity from the folk who are in jail but should not be, nor of the loss of productivity from the folk who have been released but can not work due to their "criminal record".

The black states in the map shown above are mostly in states that once were Confederates in revolt against the Union. So you see a relationship between high state incarceration rates and high rates of incarceration of black and Hispanic people?

Correlation is not causality, but I wonder whether there is a circular causality here. Perhaps racism causes under  investment in human resources -- education, health -- and lack of economic opportunity for the races that face prejudice, leading to poverty. Perhaps poverty leads to more racism as the poor seek scapegoats for their own poverty.

Lets at least get rid of the word "racism"


I suppose what bothers me is that the term allows bigots to continue believing that there is some significant genetic difference between African Americans and European Americans based on their races -that is their genetics. Race is a social concept, dividing people according to culturally transmitted classification schemes.

Scientists now know that genetics are the basis of heredity, and that the genetics of human populations today are complicated. (Check out this interactive map, for example.)

Scientists know that Homo sapiens as a species emerged in Africa, and went through hard enough times that the species was reduced to very small numbers from which all modern humans are descended. Thus it is perhaps an acceptable generalization that we are all members of the human race.

While the majority of Homo sapiens remained in Africa, some migrated into the Eurasian land mass and the species spread across Europe and Asia; some humans later migrated to Australia, the Americas and various islands. Thus, I suppose all Americans are all genetically African Americans; we share most of our genetic heritage with all Homo sapiens because we are all relatively recently descended from Africans (at least as geneticists think of evolutionary time.)

Local variations occurred and some as a result of natural selection became common in local human populations. There was most genetic diversity in Africa, the continent of origin of the species and thus the continent of longest genetic history of Homo sapiens.

It appears that there has been some introduction of genes into human populations from non-human sources. Thus it would appear that a relatively small number of genes was introduced into European human populations from Homo neanderthalensus; some of them were sufficiently useful to be retained at least locally; these include perhaps the genes for light colored skin and hair.

Anyone who has watched Finding Your Roots on TV will have a pretty good idea that African Americans tend to have a lot of European ancestors. (I remember a "Black" friend who told me after we had known each other for years that one of her grandfathers came from Ireland and the other grandfather came from Germany; I was kind of annoyed that in public she tended to deny her Irish ancestry -- something that Barack Obama does not do.) So not only do African Americans tend to have European ancestors, European Americans tend to have African ancestors. (My Irish ancestors had the belief that they descended from a people who in relatively recent times migrated from Asia via North Africa to Spain and then Ireland.)

"Hispanics" are even more clearly defined by culture than genetics, since it tends to be their common heritage of the Spanish language that defines the group. Hispanics may trace their ancestry to Spain, but in Spain people tend to be divided into such categories as coming from Aragon, Caatile, Catalonia, the Basque country, Galicia, etc. Historically in Latin America categories such as Mestizo (both Spanish and American Indian ancestry), Mulato (Spanish and African ancestry) and Zambo (European, African and American India ancestry) with torturous nomenclature for different combinations of ancestors. I find it impossible to use genetics as a basis for distinguishing Hispanics from other taxonomic groups of Homo sapiens.

So as long as the United States is stuck with prejudice of one group against another, lets find a better term. We have religious prejudice and class prejudice, why not use terms such as "cultural prejudice" or "ethnic prejudice" instead of "racial prejudice"?

A comment on the U.S. police system.

The graph on the right shows that, while the incarceration rate is higher for whites in the USA than for the general population in comparable countries, it is significantly higher for blacks than for whites in the USA, and many times higher for blacks in the USA than for the general population in comparable countries.

Murder is arguably the worst crime, and the murder rate in the USA is higher than for the general population in comparable countries; it is much higher for U.S. blacks than for U.S. whites.

Why should this be so? Clearly we in the USA are a violent people, and clearly we have policies that put a lot of people in jail. (It might be that putting a lot of people in jail and keeping them there a long time does not work in reducing violent behavior.) I believe that there is still a large amount of racism in the USA, and that as a result blacks are likely to be sequestered in black neighborhoods; also as a result, blacks are likely to be less educated and have fewer opportunities in life, leading to high crime rates in black communities where the victims are likely to be black. These observations seem so obvious that I am surprised that they are not universally recognized, especially among whites.

Most blacks are suspicious of police in the USA, much more so than whites. It seems obvious that blacks have more reason to be suspicious of police than whites do. There has been and remains much less prejudice against whites than against blacks, and blacks are much more likely meet such prejudice. I also think that it crime rates are higher among one group than among another, the police will treat the members of the high crime rate group with more suspicion.

The article suggests one helpful step -- combine small police forces into larger ones that will have the resources to select better officers and to better train them. I would think that the "war on crime" with mandatory sentencing and long sentences has been proven counterproductive. More fundamentally, we have to continue fighting against racism and work to provide more mobility for blacks. I suppose a big challenge for decades will be to rehabilitate the black men who now have criminal records and histories of long periods spent in jail.

Maybe I am too much a prisoner of my own culture, but I would suggest that the problems of some police officers in some police departments should not be exaggerated. There are some 3.6 million police officers in the USA, and I think most of them do a good job for the public. That many armed people on the streets 2000 hours a year are going to do some things that they should not do. Moreover, the policemen that I have talked to and known face a difficult job and have often been injured while doing that job. Of course, policing can and should be improved, and of course that will only happen if people demand that it be done. But it seems to me that we need to keep some perspective on the situation, and not go off half cocked as our politicians did with "the war on crime". The media don't help by ignoring the problem until an event captures the public's fleeting attention, and then too often they hype that event.

Even if the country enacts better policies now, it will take a long time to recover from the effect of the policies enacted in the 1980s.

Irish immigrants were victims of racism not so long ago

 If I'm not mistaken, the average life span of a black male slave in America during the mid 19th century was about 50 years old. But the average life span of an Irish male laborer in America at that time was under 35 years of age. 
White Irish were often used for hard dangerous work that were estimated to cost many lives to complete, such as the Erie Canal. Contracts were sent to black Slave plantations for labor, and were refused on account that the work was too brutal and dangerous for their slaves. In one case the reply was, "The work is much too harsh for our Negroes. Let the Irish do it." http://www.amazon.co...aves in America
